A D.C.-based free market group’s lawsuit challenging the constitutionality of the Sarbanes-Oxley Act could force Congress to reconsider the law. Late last month, federal Judge James Robertson of the District of Columbia heard arguments in a case brought by the Free Enterprise Fund and an accounting firm that targets the Public Company Accounting Oversight Board specifically, but that threatens SOX in its entirety. The government has intervened in the case — and isn’t sympathetic to the fund’s claims.
