A federal jury has returned a defense verdict in the first welding fumes exposure case among approximately 3,800 consolidated as part of multidistrict litigation proceeding before U.S. District Judge Kathleen O’Malley in Cleveland. The jury found that the defendants — past and current makers of welding rods — did not distribute a product with a marketing defect. A spokeswoman for the welding industry said juries have returned defense verdicts in 11 of 12 welding fume cases tried in state courts.
