An alien worker who was legally in the United States, but whose work authorization had expired and was pending renewal, was not entitled to partial unemployment benefits, the Pennsylvania Commonwealth Court has determined. Tajudeen A. Jimoh had an open claim for unemployment benefits when his alien work authorization expired in September 2004. The state unemployment board denied benefits on the grounds that Jimoh was not “available for work” as defined by law.
