The years 2002 to 2005 saw an explosion of silicosis-related legal claims — until U.S. District Judge Janis Graham Jack, who was overseeing pretrial discovery in the national silica litigation, recommended that nearly 10,000 diagnoses of silicosis be thrown out as scientifically unreliable and legally suspect. Morgan, Lewis & Bockius’ Roger K. Smith and P. Daffodil Tyminski take a closer look at Jack’s decision, which they call the key variable that tipped the scales decisively in favor of the defense.
