Jay Lapine, one of the first GCs to be indicted in the recent wave of corporate scandal, has now become one of the few to be at least partially acquitted. In November a San Francisco jury cleared Lapine of conspiracy to commit securities fraud while he was GC of HBO & Co., a medical software maker. But jurors deadlocked on six other charges, and Lapine’s defense counsel says prosecutors have decided to retry Lapine. Of the six deadlocked counts, jurors voted 11 to 1 to convict Lapine on three.
