The Justice Department’s Antitrust Division hasn’t gone to trial to block any proposed mergers in over two years — ever since Northern District of California Judge Vaughn Walker cleared the way for the Oracle-PeopleSoft merger over the objections of the division’s trust-busters. But division head Thomas Barnett rejects speculation that fear has fueled the recent trend, saying that less confrontational means are working. “We apply the law,” he says. “And if we think there’s a problem, we pursue it.”
