Rotation of judges is usually deemed a good thing, helping to foster a well-rounded bench and to ensure that no judge gets burned out in a bum assignment. But Francine Schott claims she received a gender-based transfer from a position as an “executive” civil judge to her New Jersey county’s criminal section. Last week, a state appeals panel grappled with whether Schott could make out a cause of action. Schott’s lawyer said the rotation in this case was designed to favor a male judge.
