A New Jersey Supreme Court committee wants to expand to civil cases a rule that allows evidence of prior false accusations to impeach a victim-witness’s credibility. Battered women’s advocates object to the idea, saying the court should then also allow testimony on alleged batterers’ prior bad acts. Some lawyers say the rule change might make it too difficult for judges to determine whether a dismissal of a prior dispute was caused by a false accusation or a recantation caused by other facts.
