N.Y. Judge Rules Employer’s Action Voids Pilot’s Work Contract

An airplane pilot does not have to reimburse his former employer for pilot training expenses even though he left the company after only seven months, a New York judge has ruled, granting Scott Wolkiewicz’s motion to dismiss a lawsuit filed against him by Excelaire Service Inc. The judge concluded that Wolkiewicz “was constructively discharged and forced to resign due to intolerable work conditions under which he found himself,” after Excelaire significantly reduced his hours and salary.
