Congress has not extended coverage of 42 U.S.C. §1981 beyond territorial jurisdiction of United States, with result that §1981 could not be applied to prohibit employer’s allegedly discriminatory conduct arising from oversees assignment of non-citizen plaintiff (considering extraterritorial scope of § 1981 as issue of first impression in circuit).
