Panel Rules Hurt Olympic Skater Assumed ‘Inherent Risk’ of Sport

In the latest of a long line of cases applying the assumption of risk doctrine to a sports-related accident, A New York appellate panel has upheld summary dismissal of a suit filed by a medal-winning Olympic speed skater who suffered a spinal injury when she crashed into the boards surrounding a rink in Lake Placid. But the appeal may be headed to the state high court over the issue of whether an alleged defect in safety equipment or the application of that equipment can overcome the doctrine.
