A Westchester County, N.Y., gas station has been fined $2,000 and enjoined from again taking advantage of a market disruption as it did by gouging its customers during Hurricane Katrina and its aftermath. But Supreme Court Justice Jonathan Lippman ruled out requiring My Service Center’s owner to reimburse its customers for amounts they were overcharged. Lippman found that the station had “patently” violated a state law barring retailers from jacking up prices during any “abnormal disruption of the market.”
