In a suit brought by independent bottlers against The Coca-Cola Co. and its affiliated bottler, the issues are complicated by the fact that a former Coke GC is now the executive director of the Coke bottlers’ association. The issue of whether W. Thomas Haynes can properly advise the independent bottlers, and testify on their behalf if the case goes to trial, is raising questions of ethical obligations versus contractual rights. Four Georgia law school professors, hired by the parties, are taking sides.
