U.S. Supreme Court to Rule on Clean Air Act Dispute

The U.S. Supreme Court has agreed to resolve a dispute that concerns the interpretation of two important and related Clean Air Act provisions, which could provide important guidance on how the Roberts Court views environmental issues. At issue is the 4th Circuit’s holding that, in determining what power plant “modifications” require a Prevention of Significant Deterioration permit, Congress’ definition of “modification” within the act’s New Source Performance Standards provision should apply.
